Court Report
INS contacted about illegal immigrant sentenced in Municipal Court

As a trusty from the Panola County Sheriff’s Department interpreted for him, Municipal Judge Bill McKenzie, during Wednesday’s court session, asked a young Spanish-speaking man if he was "legal."

The interpreter asked Jose Magana, 6085 Brooks Cove, Olive Branch, if he was "illegal" and his answer was "yes."

"Where are you from?" the judge asked.
"Tabasco, Mexico," Magana answered.

McKenzie sentenced him to 30 days in jail to satisfy fines for DUI, open container, no driver’s license, careless driving and no proof of insurance.
The immigration service (INS) was also contacted.

Trespassing
Barry Flowers, 234-C Martin Luther King, Batesville, entered a guilty plea to trespassing and was told to stay away from affiant Sharon Ford’s home.

"I have told him seven times to not come over!" said Ford.

"I try to reason with him because he has a sick child with my daughter," she added.

Jessie Jefferson, no address given, had a trespassing charge dismissed, but was given a court order to not go back over to Kelly Butler’s residence.

He also had contempt of court-old fines of $1,937 that have been due since June 2005.

He entered the city’s work release program for 48 days instead of paying the fines.

Possession
Crystal Turnage, 7605 Dubbs Rd., Dundee, paid a fine of $304 prior to court for possession of paraphernalia.

Anthonie Henderson, 818 Bethlehem, Batesville, entered a guilty plea to possession of marijuana (less than an ounce) and disorderly conduct-failure to comply by running from the police officer.

He was fined $960.

"Can I get the $220 back that the officer got from me?" Henderson asked the judge.

"If it’s not being held for evidence," the judge said.

"You need to pay your fine with that money," the judge added.

Sean B. Norwood, 112 Normandy, Batesville, paid his fine of $355 prior to court for possession of marijuana (less than an ounce).

Public drunk
James Johnson, 203 Draper St., Batesville, entered a guilty plea to being drunk in public.

He was fined $265.

Contempt of court
Shelton Leonard, 10 Victory Rd., Batesville, was told to have his old fines of $732 and new fines of $281 for no driver’s license, paid in full within 30 days.

Germaine Williams, 366 Tony Keating, Batesville, entered the city’s work program for 27 days instead of paying old fines of $475 that have been due since August 2006 and a new fine of $605 for disorderly conduct-failure to comply.

Willie Market, 2827 Hentz Rd., Batesville, was given 30 days to pay his old fines of $752 that have been due since April 2006.

Scotty L. Thomas, 317-D Patton Lane, Batesville, entered the city work program for 30 days for old fines of $1,228 that have been due since March 2006.

"I am going to give you a chance to not serve six months in jail," the judge warned Thomas.

If Thomas doesn’t finish the work program he will serve the time in jail.

Tracy Jackson, 979 Courtland Rd., Lambert, was told to have his old fines of $753 (due since December 2005) paid in full or serve six months in jail.

Randy Lee, 205-A Bright St., Batesville, failed to appear for contempt of court-old fines of $2,187 that have been due since June 2005.

Fox Bonding Company was notified.

Michael Lance of Blackhawk was sentenced to 60 days in jail to satisfy old fines of $710 that have been due since October 2005.

Dyenthon Barksdale had a contempt of court case continued as the judge took it under advisement.

Other
Jerry Johnson, 111 Boyle, Batesville, entered a "not guilty" plea to domestic violence and simple assault. He was fined $437 for no driver’s license and running a stop sign.

The trial will be heard February 14.

Samuel Oliver, 1607 Sanders Rd., Sardis, had a DUI, no driver’s license and no proof of insurance case continued.

Cases set for trial
Courtney Rudd, 236-B MLK, Batesville, had a possession of marijuana case dismissed.

Rudd said she was in the vehicle with her boyfriend Roman Milam, and didn’t know he had the marijuana in the console.

The judge agreed that the officer did the right thing by arresting her, but would accept her explanation.

"It is illegal to be in the presence of drugs," the judge said.

Trentle McKinney, 4945 Barnacre, Batesville, had a simple assault charge remanded to the file pending six months good behavior.

Lance McKinney, 926 Cole Springs, Sardis, also had a simple assault charge remanded to the files pending good behavior.

Willie Smith had a disorderly conduct and two counts of simple assault remanded to the files for six months pending good behavior.

Smith had accused the McKinneys of assaulting him, and the McKinneys had charged Smith with assaulting them.

All were fined $50 in court costs and were told to stay away from each other.

Tickets
David Harris, 106 Goodhaven, Batesville, had a no driver’s license, no proof of insurance and reckless driving case continued. She also had old fines of $709 that have been due since August.

Angela Benson, 109 Autumn Ave., Batesville, had a driving while license suspended fine reduced after she showed the judge she had her license reinstated. She was fined $303.

William Brasher, 114 Central St., Batesville, was given a lower fine of $92 for expired tag. The lower fine was issued after he proved he had gotten the tag fixed.

Gunn Ford, 107 Booker T. St., Batesville, was fined $281 for no driver’s license.

Marcus D. Smalley, 4838 Eureka Rd., Batesville, was fined $618 for no proof of insurance and no seat belt.

Barbara Jones, 102 Mackey Ave., Batesville, was fined $356 for driving while license suspended.

Curtis Henderson, 236 Pearson St., Batesville, was fined $465 for no tag and no driver’s license.

Keith Wooten, 123 File Rd., Batesville, was fined $705 for no proof of insurance and speeding.

Robert Anderson, 8867 Pope-Water Valley Rd., Pope, was fined $265 for open container.

Jeremy Harris, 69-A Wilborne, Sardis, was fined $540 for switched tag and driving while license suspended.

Labelle Hill, 414 Fredrick St., Sardis, was fined $723 for no proof of insurance and driving while license suspended.

Irvin Cosby, 3003 Seven Rd., Batesville, was fined $183 for no proof of insurance. The lower fine was imposed after he proved he received insurance after the ticket was issued.

Johnny Ellingburg, 134 Askew St., Water Valley, requested an extension to pay his fines of $767 for expired tag and no proof of insurance. His request was granted.

Phillip Anderson, 110 Vance Street, Batesville, was fined $281 for no driver’s license.

Derrick J. Shaw, 5487 Lucous Taylor, Como, was arrested and charged with reckless driving, no driver’s license, failure to yield to blue lights and resisting arrest. The case to be heard in Justice Court.

Roderick D. Griffin, 251 Randall Rd., Courtland, was arrested and charged with murder, drive by shooting and aggravated assault. The case to be heard in Circuit Court.

Raymond L. Barker, 160 Enid View Rd., Pope, was arrested and charged with possession of controlled substance.

January 9

Brandon M. Sullivan, 8880 Avis Rd., Hollendale, is being held for investigation.

Anthony J. Henderson, 818 Bethlehem Rd., Batesville, was arrested and charged with disorderly conduct-failure to comply and possession of marijuana. The case was heard in Batesville Municipal Court.

January 10
David W. Jacobs, 2116 Nash Rd., Batesville, was arrested and charged with public drunk. The case to be heard in Justice Court.

Danny R. Shannon, 147 Melon Rd., Jyronza, Ark., was arrested and charged with possession of methamphetamine. The case to be heard in Justice Court.

Katie J. Johnson, 315 Travis Rd., Courtland, is being held for investigation. The case to be heard inJustice Court.

Sherry L. Evans, 169 Bonner Rd., Enid, was arrested for violation of probation. The case will be heard in Circuit Court.
