Bond set at $750,000 for misdemeanor; another defendant curses city court

Judge Jay Westfaul ordered that an "unknown" man be held on a $750,000 bond for three misdemeanor charges during Batesville Municipal Court Wednesday.

Detective Paul Shivers had asked for a high bond to give police a chance to find out who he is.

The defendant, who had given several different names to police after his arrest, identified himself as Adrian McCrany after the judge explained he could be charged with perjury if he lied under oath.

The defendant said he was from Milwaukee, Wis.

"He is considered a flight risk," said Westfaul.

"I apologize for lying the first time," the defendant said.

His charges were for possession of marijuana, false information, DUI, and expired driver’s license.

After hearing the bond, the defendant was escorted to the back of the courtroom crying out loud with disbelief.

He can have a lower bond once his identity is established, the judge said.

Patrick Scruggs, 2173 Liberty Hill Rd., Courtland, was found guilty of two counts of simple assault against affiants Hayward Lee Harmon and Sandra Harmon.

Sandra Harmon testified that Scruggs was hired to do some work on a home she and her husband owned on Harmon Circle.

She said she hired Michael Goforth to do the work first and Goforth asked Scruggs to help him.

"Patrick (Scruggs) would come to work late or wouldn’t get the work done, so I let him know that we didn’t need him to work for us anymore," said Sandra.

"I paid both of them and still had to hire someone else to get the work done," she said.

She said he came to her home and started cursing threatened to vandalize her houses on Harmon Circle if he didn’t get the money.

Hayward Harmon said Scruggs had his right hand in his pocket and Harmon believed he had something in it.

Goforth, there as a witness, said he didn’t remember much because it was a year ago and he was under the influence of drugs.

The judge allowed him review a statement he’d written after the incident, alleging Scruggs had a boxcutter and was going to "cut Harmon from end to end."

"I just don’t remember," Goforth said.

Sandra Harmon asked Goforth, "Michael, if you were on drugs, why did you work for me? We were trying to help you."

Goforth replied, "I know."

Scruggs said he was going to Memphis to the substance abuse clinic and went to the Harmons’ first to get the money owed him for the work he had done.

The judge ruled that the evidence was clear that Scruggs made a threat.

He was sentenced to six months in jail with five months suspended and 30 days to serve.

As the defendant walked out he cursed, saying "This is bull _."

The judge called him back to the bench and told him he could hold him in contempt.

"But, I feel like I am being railroaded," said Scruggs

He also owes a fine of $530.

Other cases
David Herring, Skyline 401, Batesville, had domestic violence-simple assault (against a minor) charges remanded to the files for six months pending good behavior after attorney Helen Kelly and the city’s prosecuting attorney Parker Still came to an agreement.

Mike Abdallah, 210 Pine Place, Batesville, entered a guilty plea to disorderly conduct and resisting arrest. He was fined $530.

Contempt of court
James Griffin, 1229 Heafner Rd., Batesville, had old fines of $415 that have been due since October 2004 and new fines of $574 for speeding, no driver’s license and no tag. He was told to have the entire amount of $989 paid in full within 60 days.

Chesley Tidwell, 2257 Lawrence Brothers Road, Batesville, was told to have old fines of $1,735 due since March 2006 paid in full within 60 days or serve 75 days in jail.

Robert Spain, 876 Sanders Rd., Sardis, returned to court to bring proof that his old fines of $1,082 had been paid in full.

"I couldn’t find the papers that said I paid in full, so I will plead guilty," said Spain.

The judge gave Spain credit for the eight days in jail he already served making his fines $882.

James C. Johnson, 1225 Shiloh Rd., Courtland, faced contempt of court charges for old fines of $926 due since March 2004.

He was told November 22, 2006, he could be released from jail when his fine was paid or return to court for review.

Johnson told the judge he served 31 days in jail.

The judge gave him credit for the 31 days, making his fine "taken care of."

Johnson had six more days to serve.

Grand jury
Derrick Burdette, 178 Shiloh Rd., Courtland, was referred to the grand jury for aggravated assault. He also had contempt of court-old fines of $451 that have been due since September.

Charles Wesley, 103 Clinton St., Batesville, was referred to the rand jury for two counts of aggravated assault. He requested a bond reduction from the original $10,000.

"I want to be fair," said Westfaul who lowered the bond to $5,000.

Other
Barbara Hutchins, 13439 Eureka Rd., Courtland, entered a guilty plea to simple possession of marijuana, driving while license suspended and careless driving.

She was fined $842.

Tickets
Demond Jackson, 201 Patton Lane #C, Batesville, was fined $281 for no driver’s license.

Luis M. Juares, 11142 Pope Water Valley, Courtland, was fined $364 for no proof of insurance and leaving the scene of an accident.

He had a lowered fine for the no proof of insurance charge after providing proof he received insurance after the ticket was issued.

Ethel R. Davis, 109 B-1 Lester St., Batesville, was given a lower fine of $183 for no proof of insurance.

Stephanie A. Jones, 203 Leonard St. Apt. C, Batesville, also had a lower fine of $183 imposed for no proof of insurance.
