Retaliation for stink bomb brings fine in municipal court

An incident that happened after a long night of bingo August 31, was resolved with a guilty verdict on two counts of simple assault during Batesville Municipal Court Wednesday by Judge Bill McKenzie.

The judge issued a guilty verdict against Virgia Sanford, 1050-A Wells Ext., Courtland, after affiants Rebecca Gill and Erica Berryhill testified that Sanford pushed both of them in the chest after a misunderstanding.

"She was upset because she thought we threw a stink bomb at her," said Gill.

Gill said earlier in the night they had a confrontation over seating arrangements at bingo.

Berryhill testified that Sanford "got in her face" and started pointing her finger in her face.

"She shoved me hard enough to fall into my van."

Witness Dawn Mitchell testified that her cousin did drop a "stink bomb" out of her purse on accident while getting her cell phone out.

Sanford testified that they did exchange "words" about the seating arrangements at bingo.

"When the game was over they threw a stink bomb at me," Sanford said.

"My daughter told me that one of them dropped something behind my seat."

Sgt. Ruby Myers told the judge she arrived at the scene, the Batesville Lions Club, where weekly bingo games are held, and found a substance that appeared to be a "stink bomb."

The judge said that the charges were proven with adequate witnesses and it’s sad when "grown folks act like children."

He also said next time they are in the same place together to stay away from each other and "don’t make a big stink over it."

Sanford was fined $530.

Other cases set for trial
Tabitha B. Pittman, 19108 Hwy. 51, Sardis, entered a "not guilty" plea to shoplifting at Dollar General last week.

Tom Gurley with Dollar General appeared to testify, but Pittman asked the judge, "can I just change my plea to guilty?"

"You could have saved us some time," the judge replied.

Pittman was fined $610.

John Wilson
, 118 Ozbirn, Batesville, was found guilty of domestic violence-simple assault against his wife Kadesha Wilson.

Wilson admitted he threw a fan that hit the wall and bounced off the table and scratched her foot.

"And that isn’t violent?" asked the judge.

Wilson also admitted he "pretended" to have a pistol to scare her.

Kadesha Wilson testified that she was scared and had never seen him get that mad.

"I thought he had a gun, but it wasn’t a gun," she said.

Wilson told the judge he didn’t own a pistol, but Sgt. Ruby Myers testified that when she arrested Wilson a week after the domestic violence incident, she did find a pistol in his car.

"You need to learn to resolve your problems without using violence," the judge said.

The judge also advised Wilson to keep a clean record for two years and to not keep a firearm in his possession.

He was fined $620.

Grand jury
Robert Raines, 16 Robin Rd., Water Valley, was transferred to the grand jury for grand larceny.
Contempt of court

Robert Spain, 876 Sanders Rd., Sardis, had old fines of $1,082 that have been due since June 2006.
The case was continued after Spain told the judge he could bring proof that he paid his old fines.

Ronnie Porter, Tubbs Rd., Batesville, had old fines of $525 that have been due since March 2006.

"Can I pay a monthly plan?" Porter asked.

"We don’t do monthly plans. You have had nine months to save money," the judge replied.

Spain told the judge he had a wife and kids and that was the reason he hadn’t paid the fines.

When the judge asked him if he had a job, Porter told the judge he received a social security check.

His old fines were due to unpaid tickets for marijuana and no driver’s license.

"So you can afford marijuana, but you can’t afford to pay your old fines?" the judge asked.

McKenzie told Porter to have the old fines paid in full within 90 days or serve time in jail.

Dennis Brown, 643 Stephen Rd., Como, had old fines of $954 that have been due since March 2004.

Brown told the judge he had been in an accident and had medical problems, but said he could pay $734 of the fines immediately.

The judge accepted his explanation and told Brown to pay the balance of $220 by January 3.

Other
Willie Reed, 101 Martinez, Batesville, entered a not guilty plea to disorderly conduct-failure to comply and careless driving. A trial will be January 3.

Reed entered a guilty plea to no driver’s license and was fined $281.

Ronald Hoskins, 335 Shamrock #11-D, Batesville, entered a guilty plea to DUI and running a stop sign. He was fined $882.

Carlos Brassell, 956 Lawrence Brothers Rd., Batesville, entered a guilty plea to embezzlement for taking a tire from Wal-Mart worth $66.96 in 2003.

He was fined $305.

Tickets
Cynthia C. Miles, 211 Tubbs #7, Batesville, had a no proof of insurance ticket dismissed after providing proof she had insurance when the ticket was issued. She was fined $113 for speeding.

Candice Strong, 148 Hwy. 51, Courtland, had a lower insurance fine of $183 imposed after proving he received insurance after the ticket was issued.

James Earl Houston, 500 Armstrong St., Batesville, was given a lower insurance fine of $183 after proving he received insurance after the ticket was issued.

Christopher G. Tisdale, 88 Floyd’s Island, Sardis, was fined $864 for no driver’s license and no proof of insurance.

Stephanie Frost, 2559-A Hentz Rd., Courtland, was told to come back with proof of insurance to save her $400.

If she doesn’t receive insurance, her total fines will be $898 for no proof of insurance, no child restraint and no tag.
