City Court Report
Judge McKenzie sets trial date for ‘compulsive’ shoe changer

A Marks woman returned to Batesville Municipal Court after Detective Paul Shivers investigated a false pretense charge.

Yolanda Davis
, 808 Third St., Marks, told Judge Bill McKenzie last court session that she did not have a cell phone in affiant Sharon Primer’s name.

Davis pled guilty to the charge and was ordered to pay state assessment fees of $105 and restitution of $291 and a fine of $305.

The fine will be remanded for a period of one year pending no further criminal activities.

Aretha Jenkins was found guilty of false information, forgery and false pretense. Detective Paul Shivers requested that all charges be amended to misdemeanor charges and that restitution of $430 be paid in 30 days with a fine of $610 due in 60 days.

Shoplifting
Cecelia McCain, 959 Chickasaw, Pope, entered a not guilty plea to taking a pair of Nike shoes worth $64.19 from Factory Brand Shoes.

"I have a compulsive disorder. My shoes have to be clean. I went to my car to change my shoes," said McCain.

She also added that she had a pair of shoes in the car in case her shoes got dirty during court.

A trial date was set for February 1.

Heather Stubbs, 5687-B Eureka Rd., Courtland, entered a guilty plea to taking two packs of underwear worth $9.92 from Wal-Mart.

Her mother spoke up saying, "Her boyfriend taught her to steal. I want her to have something tougher than a fine."

Judge McKenzie told Stubbs that second offenders go to jail and that there is no justification for stealing.

She was fined $610.

Other
James Turner, 104 Jackson St., Batesville, entered a guilty plea to resisting arrest and disorderly conduct-failure to comply.

Turner told the judge he was trying to get a disability check, but can work on the city’s work release program in lieu of paying $870.

He was ordered to work 15 days on the city work program. Seven days were "knocked off" because he already served the days in the county jail.

The city’s work release program is an option for defendants who cannot pay their fines.

Simple assault
Christina Hines, 3671 Bethlehem Rd., Batesville, had a simple assault charge remanded to the file after the defendant told Judge McKenzie, "I let her stay with me and I have gotten her out of jail before."

The judge asked affiant Tiffany Heffner, "This is how you pay her back? Do you want me to put her in jail?"

Heffner just shrugged. The case was remanded.

DUI
Dempsey Cox, 1278 Shiloh Rd., Courtland, had a DUI (second), careless driving and no driver’s license case continued.

Contempt of Court
Earnestine Swiney, 3187 Hwy. 51 South, Pope, had contempt of court old fines of $234 that have been due since May 2003. She told the judge she didn’t know anything about the old fines, so Judge McKenzie gave her the opportunity to sit down and look through the paper work.

Her contempt of court charges were due to old tickets for no proof of insurance and no child restraint. The court clerk, Renee Hubbard, looked through her files and told Judge McKenzie that someone did appear in court for the no proof of insurance ticket.

Swiney told the judge that her niece did know her social security card number and could have used it when she was pulled over.

Swiney agreed to pay the fine of $234.

Latoya Brown, 1004 Chapman Cove, Oxford, had contempt of court-old fines of $500 that have been due since July 2004. When Brown was asked why she didn’t appear in court on a previous date, she responded, "I have had my address changed. I didn’t know when court was."

Judge McKenzie told her to look at her ticket, which clearly states on the bottom when her court date was.

Brown was ordered to pay her old fines of $500 or serve 90 days in jail.

Robert Smith, 102 Gracie Cove, Batesville, had old fines of $334 that have been due since November 2004. He was ordered to pay the entire fine within 30 days or serve 30 days in jail.

Sylvester Boyce, P.O. Box 803, Como, had old fines of $550 that have been due since May 2005. He is being held for other charges. The judge sentenced him to 30 days in jail to "clear this up."

James Lee, 216 West St., Batesville, had old fines of $1,036 that have been due since May 2005. He has eight other felony charges pending, so he was ordered to serve time until his fine is paid.

Lee tried to explain to the judge that he has been in jail and can’t pay the fines.

Judge McKenzie responded, "If you can pay a bail bondsman, you can pay the fine."

Randy Lee, 205-A Bright St., Batesville, had contempt of court-old fines of $2,187 that have been due since June 2005. He was previously ordered to serve 10 days for DUI (second) beginning July 1, 2005, but never served the time.

"I went up there to do the time and Shot Bright told me to go home," said Lee.

The trial was continued until January 18 with Sheriff Shot Bright to verify what Lee said.

Tickets
Marcus Holmes
, 720 Martin Luther King Dr., Oxford, contested a speeding charge and a trial date was set for January 25.

Tiffany Meeks, 790 Leigh Ave., Grenada, was fined a total of $671, for no tag, driving while license suspended and no child restraint.

Tiffany Rodgers, 10480 Kleinn Rd. Apt. 22, Gulfport, contested a speeding charge, but had a driving while license suspended charge dismissed.

She showed proof that she had a valid license.

Courtney Boyette, 6189 Hwy. 51 South, Pope, had a no proof of insurance charge dismissed after showing valid proof of insurance.

Anthony C. Crump, 78 Coon Butler Rd., Batesville, contested a driving while license suspended charge. A trial was set for January 25. If he is found guilty, he will be fined $356.
