City Court Report
Shoplifting kicks off municipal court docket

A young man from Oxford had a trial set for July 20 after pleading not guilty to stealing a pair of K Swiss tennis shoes worth $59.99 from Rack Room Shoes.
In Municipal Court Wednesday, Fredrick Holmes of Lot 28 CR 1090, Oxford, said, "They (police officers) found the shoes in the car I was sitting in."

Officer Billy Sossaman was the arresting officer and told Judge McKenzie the clerk and the security guard saw him take the shoes from the store.

If Holmes is found guilty he could pay a fine of $595 for shoplifting.

In another shoplifting case, Lisa Burton of 2106 Center St., Clarksdale, failed to appear to answer a shoplifting charge.

Domestic violence
Robert Karsten of 134 Oakleigh Dr., Batesville, was charged with pushing Elizabeth Keel of 1405 CR 100, Water Valley. Both Karsten and Keel pled not guilty and a trial was set for August 1.

A warrant was issued for the arrest of Timothy Austin of 104 Jones St., Batesville, after he failed to appear for a domestic violence (second offense) charge.

Julie Austin of 104 Jones St., Batesville, was also charged with domestic violence (second offense). She told Judge McKenzie she was defending herself. A trial was set for July 13.

A trial was heard for Evelyn McKinney of 14199 Ballentine Rd., Batesville, after she pled not guilty to domestic violence against Jamarr Smith.

McKinney told Judge McKenzie, "My cousin gave me the bat after he hit me to get rid of him. He ran in and got a gun and put it to my head. I was trying to defend myself."

McKinney also admitted to trying to hit Smith with the baseball bat while he was being arrested.

Judge McKenzie found McKinney guilty and said, "Two wrongs don’t make a right."

She was fined $345.

Trespassing
Clinton Shields of 19576 Hwy. 6, Batesville, pled not guilty to trespassing on Donald Matthews’ land.
Matthews told Judge McKenzie he had told Shields several times to stay off his land.

Shields told the judge, "I have never talked to this man."

A trial was set for July 20.

Possession
Kenneth Smith of 401 Boothe St., Batesville, was found guilty of possession of marijuana less than an ounce. He was fined $345.

Cornelius Wells of 217 Noble St., Batesville, is to satisfy an old fine of $944 and a fine of $345 for possession of marijuana less than an ounce (second offense) by performing 32 days of public service in the city’s work release program. Participation in the work program is an option for defendants who cannot pay their fines.

Petit larceny
Judge McKenzie dismissed a charge of petit larceny against defendant Malcolm Benson of 124 Martinez, Batesville, after the affiant Brittney Benson failed to appear in court to prosecute the charges.

Disorderly conduct
Annie Blackburn of 104 Patton Lane, Batesville, was fined $255 for disorderly conduct.

DUI
Michael James of 949-A Wells Ext., Courtland, was charged with DUI-other, possession of paraphernalia (crack pipe), no driver’s license and no proof of insurance.

"The pipe wasn’t mine. I don’t mess with crack." said James in entering a "not guilty" plea.

Judge McKenzie set a trial date of July 20 for James.

Jermaine House of 339 Hayes St., Batesville, was found guilty of DUI (second), resisting arrest and loud music. He opted to work on the city work program for 42 days instead of paying a fine of $1,581. He will also serve five days in jail.

Melanie Rose of 3572 Mt. Olivet, Batesville, had her DUI trial set for a later date.

Contempt of court
Michael Rudd of 1321 Hentz Rd., Pope, was ordered to pay his old fines of $395 that have been due since July of 2004 by August 8 or serve 90 days in the county jail. Rudd also had a new fine of $281 for no driver’s license.

Rico Turner of 101 Dora St., Batesville, paid his old fines of $605 prior to court.

John Simmons Jr. of 8 Savanah Rd., Lambert, was given 30 days to pay an old fine of $280 that has been due since April of 2004 and a new fine of $691 for driving while license suspended or serve 90 days in jail.

"We are not going to beg people to do what they are supposed to do," said Judge McKenzie.

Stephen Beavers of 218 Broad, Batesville, had a 90-day jail sentence suspended pending completion of his work program assignment.

Beavers gave the judge a doctor’s excuse, but it was his aunt’s.

"We are not running a kindergarten class," said Judge McKenzie.

Beavers was ordered to finish the work program.

"If you miss one hour you do 90 days in jail," said Judge McKenzie.

Brandon Newman of Liberty Hill Rd., Courtland, was ordered to serve six months jail time for old fines of $1,301 that had been due since September of 2004. Newman will have 90 days after completing jail time to pay his fines.

Sameika Robinson of 203-D Leonard St., Batesville, was ordered to serve 30 days in jail and to pay an old fine of $434 that has been due since March of 2003.
 
"I am not going to pay my fines," said Robinson.

"You made the decision to do the time and you still owe a fine," said Judge McKenzie.

Tickets
Lisa Joslin of 6806 Curtis Rd., Batesville, opted to enroll in the city work program for 26 days instead of paying $1,055 for no proof of insurance.

Kerrie M. Staten of 14330 Main St., Coffeeville, was fined $174 for expired tag.

Kendrick A. Hunt of 108 Autumn Ave., Batesville, was fined $26 for speeding.

Sherry Thompson of 56 2B CR, Abbeville, had a handicapped parking violation dismissed after presenting a valid decal.

Jeffrey P. Wright of 523 Pope-Water Valley, Pope, was fined $115 for careless driving.

Timothy Lee of 84 F Azzie Lee Rd., Courtland, was fined $494 for expired tag, no driver’s license and no proof of insurance.
