Judge dismisses assault charge filed after Facebook drama

During a long trial in Batesville Municipal Court, Judge Bill McKenzie found a defendant not guilty of simple assault due to lack of evidence.

Parish Fondren, 237 MLK, Batesville, was found not guilty of simple assault. Fondren had been accused of  throwing a tree limb and hitting Kellsey Turner in the face at her home on 106 Jackson St., Batesville.

Three witnesses testified but none of them saw the incident that allegedly occurred on August 25.

The only testimonies that came from Fondren and Turner were about fussing via Facebook and text.

“Is there not a way to block someone on Facebook or on your phone?” the judge asked Turner.

The defendant and affiant both argued about messages and showed the judge Facebook messages that were corresponded between them.

“The charge is not proven,” ruled McKenzie.

Chase C. Roberts, 273 Farrish Gravel, Batesville, was referred to the grand jury for felony fleeing, reckless driving, driving while license suspended, trespassing, shoplifting and old fines of $3,728.75 that have been due since February 2010.

Derrick Pride, 6084 Curtis Rd., Batesville, was referred to the grand jury for possession of a weapon by a convicted felon. He had a malicious mischief charge dismissed after the affiant, Myeisha Robinson failed to appear to prosecute.

George Todd Jr., 330 Ford Rd., Batesville, entered a guilty plea to possession of marijuana with intent and resisting arrest. MDOC has a hold on him.

Kajaravis Bradford, 108 Vance St., Batesville, was referred to the grand jury for grand larceny.

Rickey T. Redd, 105 Tubbs Rd., Batesville, had a charge of domestic violence-simple assault amended to public drunk.

Austin D. Melton, 219 Hubbard Rd., Pope, was represented by attorney Tom Womble for DUI and driving while license suspended. Womble and the city’s prosecuting attorney came to an agreement that Melton’s DUI would fall under the common law DUI and he would attend MASEP classes. He was fined $1,160.

Jimmy Redwine, 189 Northwood Dr., Batesville, had a case continued for simple possession of controlled substance and public drunk.

Willie Pride, 684 Curtis Rd., Batesville, entered a guilty plea to public drunk and was fined $314.

Dylan J. Wright, 227 W. Hays, Batesville, was sentenced to the seven days he had already served in jail for possession of marijuana in a vehicle.

Deven Scott, 227 W. Hays, Batesville, entered a guilty plea to possession of marijuana in a vehicle. He was fined $1,017.

Treanda Robinson, 227 W. Hays, Batesville, entered a guilty plea to possession of marijuana in a vehicle. He entered the city work release program for 12 days in lieu of paying his fine.

Jermichael Joiner, 912 Brittany Dr., Oxford, entered the city’s work program for 18 days in lieu of paying $1,005 for possession of marijuana in a vehicle and old fines of $310 that have been due since September 2012.

Tyrone Whitten, 117 Hoskins, Batesville, had a case continued for indecent exposure, public drunk and resisting arrest continued.

Dekedris McMillan, 39 Tubbs Rd., Batesville, entered a guilty plea to petit larceny by taking $17.32 of gas from Kangaroo.

McMillan said he would plead guilty but he was not the one who was driving the car.
He was ordered to pay restitution of $17.32 and given time served for the seven days he spent in jail.

Reginald Edwards, 102 Dora St., Batesville, entered a guilty plea to shoplifting deodorant and aftershave worth $7.25 from Family Dollar and abusing members of police. MDOC has a hold on Edwards.

Edwards told the judge he had time over his head at the penitentiary.

“You mean you have five years penitentiary time over your head and you steal deodorant?” the judge asked.

Edwards was fined $1,166.

Antonio Mister, 330 Ford Rd., Batesville, had a simple assault charge dismissed after affiant Katherine Barnes failed to appear to prosecute.

A trial was set for October 24 for disorderly conduct-failure to comply, contempt of court – failure to appear, false information no seat belt and no driver’s license.

Mitzi Williams, 432 Tubbs Rd., Batesville, entered a not guilty plea to domestic violence – simple assault. A trial was set for November 14.

George L. Ards, 106 Bradford, Batesville, entered guilty pleas to DUI, driving while license suspended, no seat belt and no proof of insurance. He was fined $1,800.

Jessica Howell, 3328 Curtis Rd., Batesville, had a case for simple assault and trespassing dismissed after the affiant, Lawanda Holcomb failed to appear to prosecute.

Jennifer Denley, 304 Woodruff, Courtland, was found guilty of open container during a case set for trial. No fine was imposed.

Tiffanie Gatlin, 274 Cherry Bark, Courtland, had a simple assault case dismissed after the affiant, Kenneth Gaitlin failed to appear to prosecute.

Anthonie J. Henderson, 818 Bethlehem, Batesville, was fined $155 for improper  equipment.

Kelby L. Embry, 360 Mt. Olive Rd., Grenada, was fined $226 for reckless driving.

Tiarra Lasha Nelson, 412 McClyde Rd., Como, was fined $212 for expired tag.

Gregory B. Andrews, 106 Gracie Cove, Batesville, entered a not guilty plea to driving while license suspended. A trial was set for November 14.
