Stores’ witnesses don’t show;  defendant’s charge dismissed

By Emily Williams

Judge Bill McKenzie dismissed a false pretense case during Municipal Court held Wednesday due to lack of evidence.

Clara Goodwin, 705 McDade Circle, Crenshaw, had been charged with using a stolen debit card for transactions for $65.22 at Citi Trends, $101.65 at Hibbett and $75.26 at Rue 21.

Debit card owner Katie Kitchens told the judge she did not know the defendant but had a habit of leaving her card in the console of her boyfriend’s truck when they swapped out vehicles.
She said the defendant is employed at the same place as her boyfriend.

Police Detective Tommy Crutcher said the stores gave a description of the person who used the card but none of the stores had a surveillance camera working.

Crutcher said he got information that the defendant was on video in Crenshaw at a gas station there, obtained the video and showed it to personnel at the other stores who said the woman in the video was the one who made the purchases.

None of the store employees were in court to testify.

Kitchens said she noticed her card was missing when she tried to use it on May 18 for her child’s birthday. She said she saw records of the transactions after going to the bank.

After the video footage was played in court, showing Goodwin making the transaction in Crenshaw, Goodwin showed the judge a receipt from that particular transaction, verifying that she had paid it herself.

The case was dismissed due to lack of evidence.
