Judge continues case of pregnant offender

After hearing testimonies from both affiant and defendant, Judge Bill McKenzie ruled a Sardis woman was guilty of DUI second (other), during Batesville Municipal Court Wednesday.

Tammy Alred, 19697-B Hwy. 51, Sardis, said she was reaching for her cigarette case when she hit a pole in the Fred’s parking lot causing the passenger of the vehicle to be transported to Tri-Lakes Medical Center.

The arresting officer testified that Alred admitted to taking a couple of "Xanax bars." He also had a tape with Alred admitting she had taken the medication a couple of hours prior to the accident.

Alred told Judge McKenzie she did have a prescription to Xanax.

She was sentenced five days in jail and fined $1,224.

Second DUI offenders are required to serve time in jail.

Adam Goodwin, Como, was found guilty of DUI and fined $726. He also enrolled in driving school.

The judge dismissed charges of improper turn and careless driving after the city prosecuting attorney and the defendant’s attorney came to an agreement.

Corey Chaudoin, 6882 Quailfield Lane, Bartlett, Tenn., entered a guilty plea to DUI first (drugs), possession of marijuana in a vehicle (less than an ounce) at Maggie T’s, open container of Crown Royal and minor in possession. He was fined $1,901.
 
He also had a no proof of insurance charge dismissed after providing valid proof.

Judge McKenzie told Chaudoin, "Your run in with drugs and alcohol has been expensive."

Demarcus Banyard, 6565 Rankin Rd., Canton, entered a guilty plea to possession of marijuana (less than an ounce). He was previously a student at the Batesville Job Corps, but told Judge McKenzie he probably wouldn’t be able to return.

"It is a lot easier to live inside the law," said Judge McKenzie.

Banyard was given "time served" for the 10 days he already served.

Grand jury
Jermaine Tunson, 9718 Hwy. 51 South, Courtland, was referred to Circuit Court for aggravated assault.

Aretha Jenkins, 115 Martin Luther King, Batesville, was referred to Circuit Court for felony false pretense.

Christopher Haney, 37 Ivy Gordon Dr., Batesville, was referred to Circuit Court for forgery.

Allen Clay, 362 Dinan, West Helena, Ark., was referred to Circuit Court for forged prescription.
Contempt of Court

Alexander Mister, 109 Autumn, Batesville, entered in the city’s work release program for 57 days instead of paying old fines of $2,303 that have been due since August 2005. He also had a simple assault charge dismissed after affiant Malcolm Handy failed to appear to prosecute.

Larry Ford, 2074 Morrow Rd., Courtland, failed to appear for contempt of court – old fines of $415 that have been due since November 2004. Al Williams bonding company was notified.

Ronald Lancaster Jr., 4815 Darling, Sledge, failed to appear for contempt of court – old fines of $2,002 that have been due since April 2005. Al Williams bonding company was notified.

Teresa Brooks, 203 Deaton St., Batesville, was arrested and charged with contempt of court – old fines of $1,120 that have been due since June 2005. She enrolled in the city’s work release program for 28 days.

James Wilbourn, 102 Wilbourne, Sardis, had old fines of $348 that have been due since June 2000. When Judge McKenzie mentioned working on the work program, Wilbourn was unsure if he could get out of jail.

"I got caught with a little sack of weed in the jail," he said.

He owes a Justice Court fine and when he gets out of jail, he will work for the city’s work release program for nine days.

Adam Oliver had contempt of court-old fines of $1,408 that have been due since February 2004. He also had a warrant issued last court date – revocation of six months sentence and an additional month to serve for domestic violence – simple (found guilty in absentia).

When the judge told Oliver he failed to appear in court last Wednesday, Oliver said, "Y’all are
wrong!"

Oliver was sent back to jail to finish his sentence.

Reginald Henderson, 112 Williams St., Batesville, had contempt of court – old fines of $4,310 that have been due since June 2003. He is due to report back after having surgery.

Tiffany Rodgers, 10480 Klien Rd., Gulfport, contested a speeding charge.

"I was speeding, but it wasn’t a 45, it was a 55 (mile per hour zone)."

She was fined $137 and enrolled in driving school.

Reginald Tayor entered the city’s work release program for 104 days for contempt of court -old fines.

Other
Liketer Harrell, North Panola Apartments, Batesville, was charged with false information, contempt of court – old fines, expired tag and no insurance.

Harrell said she used her sister’s name when she was pulled over because she knew she had contempt charges and didn’t want to go to jail.

She also came to court twice saying she was her sister, Monesha Fletcher.

Harrell is seven months pregnant, making Judge McKenzie skeptical about putting her on the city’s work release program.

Judge McKenzie continued the case.

Tickets
Charles Chandler, 1615 Ales Rd., Batesville, was fined $540 for no tag and driving while license suspended.

Barbara Hutchenson, 3469 Shiloh Rd., Courtland, had a no proof of insurance charge continued.

She could save $400 if she brings back valid proof of insurance.

Johnathon Parker, 302 Patton Lane, Batesville, was fined $356 for driving while license suspended.
Natasha Pope, 538 Green Rd., Pope, was fined $275 for no proof of insurance, expired tag and expired license.

She got insurance after the ticket was issued, renewed her tag and renewed her license prior to court.

"You saved some money by taking care of business, " said Judge McKenzie.

Erica L. Fondren, 1272 Will Stewart Rd., Batesville, was fined $596 for no driver’s license, no child restraint and no tag.

Jordon Walker, 219 Westmoreland, had a no proof of insurance charge dismissed after providing valid proof.

"Keep insurance on board to avoid coming to court," said Judge McKenzie.

Brandon Cox, 107 Sweetgum Dr., Batesville, was fined $767 for no proof of insurance and expired tag. The expired tag fine was reduced 50 percent after Cox showed he had gotten a valid tag after the ticket was issued.

Bennie E. Rudd, 236-B Martin Luther King, Batesville, was fined $540 for driving while license suspended and expired tag.

Sammy K. Phillips, 956 Lawrence Brothers, Batesville, was fined $864 for no driver’s license and no proof of insurance.
