Three shoplifting cases come before municipal court

Judge Bill McKenzie referred two defendants to  the grand jury during Batesville Municipal Court Wednesday.

Larry Holliday, 270 Letha Wiley, Sardis, was referred to the grand jury for felony DUI, driving while license suspended and no proof of insurance.

Shelly Gordon Jr., 207 Lester St., Batesville, was bound over to the grand jury for felony embezzlement from Hibbit Sports.

Brittany Self, 5267 Hwy. 51 South, Pope, paid her fines of $1,124 in full prior to court for shoplifting three food items and a coke worth $12.84 from Walmart. She was taken into custody after court. The DA had a hold on her.

Bridget Deloach, 4552 Pope Crowder, Enid, entered a not guilty plea to shoplifting a mobile cell cover and a Slim Jim worth $17.94 from Walmart. A trial was set for Jan. 25.

Reco Roberts, 105 Hughes, Sledge, entered a guilty plea to shoplifting earrings and deli chicken worth $19.07 from Walmart. She was fined $1,124.

Suronda Vaughn, 218 Noble, Batesville, had a malicious mischief and petit larceny charge dismissed after the affiant Michael Lawson failed to appear to prosecute.

Justin Harmon, 536 Callie Norwood, Sardis, had two counts of simple assault continued until January 18.

Justin Langston, 116 Cole Dr., Batesville, entered the city’s work program for 8 days in lieu of paying $420 for simple possession of marijuana.

Jeremy Wright, 116 Cole Dr., Batesville, entered the city’s work program for 19 days in lieu of paying $1,093 for simple possession of marijuana, possession of paraphernalia and open container.

Steven Harris, 116 Cole Dr., Batesville, entered the city’s work program in lieu of paying fines of $916 for simple possession of marijuana and old fines of $496 that have been due since May 2011.

Cases set for trial

Marcus Hodges, 116 Perry Dr., Lyon, had a stop sign violation charge dismissed.

McNicko Giles, 206 Arizona, Batesville, entered the city’s work program for 18 days in lieu of paying $1,553 for disorderly conduct-failure to comply, resisting arrest and abusing members of police.
Officer Stonestreet testified he received a call about a brother and sister fighting.

Stonestreet said when he arrived at the home the mother said everything was OK, but he could hear arguing as he stood outside of the residence.

“I told him (Giles) to come speak to me,” said Stonestreet.

Stonestreet said Giles replied with a vulgar remark.

“Then he put a dresser in front of the door and barricaded himself in,” the officer said.

Giles said his sister called the police and they were not fighting. He said, “I put a dresser up in my room because my four year old nephew will come in my room messing with me. I got a bad nephew. He will mess you up. You wake up with things all painted on you and things all messed up,” added Giles.

“How old are you and your sister?” the judge asked.

Giles replied he was 39 and his sister is 32.

“Do you have anything else you want to add?” McKenzie asked Stonestreet before he ruled.

“I have it on tape,” replied Stonestreet.

McKenzie ruled the charge was correct.
