Wal-Mart theft kicks off busy session for Batesville Municpal Court judge

A young lady was sentenced in Wednesday’s session of Batesville Municipal Court to 30 days in jail for taking clothes from Wal-Mart worth $20.92.

Judge Bill McKenzie III had no choice but to sentence Latiffany Dishmon of 213 Dewberry St., Sardis, to 30 days in jail due to her previous shoplifting charge in March of 2005. Second shoplifting offenders are required to serve time.

She also had contempt-of-court fines of $765, making her total fines $1,870.

Judge McKenzie advised her to pay the total amount of the fines when she gets out of jail within 30 days or she will serve six months in jail.

In another shoplifting charge, Vanessa Willingham of 329 Alonza Gipson, Sardis, entered a guilty plea to taking $41.68 worth of clothes from Wal-Mart. She was ordered to pay her fine of $610 within 30 days or serve 30 days.

"Pay the fine or serve the time," said Judge McKenzie.

Lashon Carpenter of 201 Petit St., Batesville, admitted to taking a pair of Nike high-top shoes worth $54.99 from Factory Brand Shoes. She was fined $610.

"Stealing is just wrong, there is no excuse for
stealing," replied Judge McKenzie.

Contempt of Court
Bobby D. Johnson
of 522 Gleeton Rd., Pope, failed to appear for contempt of court-old fines of $459 that have been due since May of 2005. Alright Bonding Company was notified.

Joshua Floyd of 316 Sixth St., Marks, had a case continued after realizing that his brother had used his driver’s license in Tunica County and incurred tickets, causing Floyd’s driver’s license to be suspended along with contempt of court fines. Judge McKenzie advised him to press charges against his brother to get everything "straightened out."

Cornelius Wells of 217 Noble St., Batesville, had contempt of court-old fines of $1,444 that have been due since July of 2005. He was sentenced to 30 days in jail for failure to complete the work program, which is offered for defendants who cannot pay their fines.

Katie Johnson of 315 Travis Rd., Courtland, had charges of contempt of court-old fines ($465 due since March of 2005) continued to a later date.
Other

Jayunn Whitten of 117 Hoskins Rd., Batesville, entered a guilty plea to disorderly conduct-failure to comply with officer’s request on Martin Luther King Drive and expired tag. He was fined $789.

Maurice Milton of 5721 Nash Rd., Batesville, had a simple assault charge dismissed after affiant Barbara Collins failed to appear to prosecute. He entered a guilty plea to driving while license suspended. He was fined $356.

Alisha Clay of 92-A Heafner Rd., Batesville, was found guilty of running a stop sign after Judge McKenzie heard testimonies from Officer Michael Roberts and the defendant, Clay. She was ordered to pay a fine of $156.

D’Mariuss McMillan of 225 Noble St., Batesville, was found guilty of switched tag and was fined $184.

Darrell Chambers of 1169 Heafner Rd., Batesville, had petit larceny and burglary charges remanded to the files. He was also previously found guilty of shoplifting and his time was already served awaiting trial.

DUI
Larry Cook of 116 Johnson, Batesville, entered a guilty plea to DUI and open container. He also enrolled in driving school to reduce his driver’s license suspension time. He was fined $991.

Galon Shorter of 701 S. Pocahontas, Sardis, failed to appear for DUI-refusal, no proof of insurance and old fines of $344. Al Williams Bonding Company was notified.

Lewis Sanford of 4801 Eureka Rd., Batesville, entered a guilty plea to DUI and was fined $726. He was also enrolled in MASAP a driving school to help reduce his license suspension.

Justin Person of 35 CR 317, Oxford, was fined $462 for expired driver’s license and reckless driving. He entered a not guilty plea to DUI (other) and a trial date was set for November 9.

Grand jury
Darrin L. Ford of 230-A Carlisle Rd., Courtland, was bound over to the grand jury for felony fleeing-failure to stop, driving while license suspended, running a stop sign and reckless driving. His bond is $2,500.

Carlos McGhee of 111 Cole Dr., Batesville, and Tony Hughes of 208 Claude St., Batesville, were both bound over to the grand jury for possession of controlled substance with intent to distribute.

Keyondas Polk of Northpark, Batesville, was bound over to the grand jury for statutory rape, burglary and petit larceny. His bond was reduced from $7,500 to $5,000.

Gary Hester of 803 Redhill, Batesville, was bound over to the grand jury for DUI (third), open container, driving while license suspended (implied consent), no proof of insurance and obstruction of city street.

Tickets
Wendy Sullivan was charged with no proof of insurance. She was fined $583.

Willie E. McClain of 339 W. Govan St., Grenada, was fined $184 for expired tag. He had a no proof of insurance charge, but it was dismissed after he provided valid proof.

Brenda Hill of 167-B Martin Luther King Drive, Batesville, was fined $281 for no driver’s license.

Felicia Williams of 105 Goodhaven Rd., Batesville, was fined $131 for no child restraint.

"The issue is trying to keep children from being hurt," said Judge McKenzie.

James A. Searcy of 2438 Ellis Rd., Brookhaven, was charged with no proof of insurance. He said his girlfriend lost his valid insurance card. Judge McKenzie gave him two weeks to bring valid proof of insurance.

Lashonda Osborn of 307 Juanita St., Sardis, had a no driver’s license charge dismissed after providing proof she reinstated her license.

Vallene Owens of 324 Patton Lane, Batesville, returned to court to ask if she could enroll in the City Work Program for 15 days in lieu of paying $610 in old fines.

The city’s work release program is an option for defendants who cannot pay their fines.

Latasha Harris, P.O. Box 742, Batesville, also enrolled in the city’s work release program for 22 days in lieu of paying $864 in old fines.

Terry Jones, P.O. Box 172, Sardis, returned from last week to show Judge McKenzie paper work that was obviously an administrative error for a driving while license suspended charge. The charge was dismissed.
