Aldermen approve smoking ban 4 to 1

The City of Batesville has banned smoking in private businesses and on city-owned property.

The ban begins March 4.

That is the effective date of the non-smoking ordinance, adopted by the Mayor and Board of Aldermen, during Tuesday’s meeting.

The city leaders voted 4-1, with Ward 1 Alderman Bill Dugger casting the lone nay vote.

City leaders began discussing a non-smoking ordinance Jan. 19 when aldermen asked assistant city attorney Colmon Mitchell to draft an ordinance for consideration.

The ban will include all businesses and city-owned property.

“That would mean no smoking on the Downtown Square, Patton Lane Park or any of the city’s baseball fields.

Ward 4 Alderman Eddie Nabors, who first brought up the city going no smoking, said property owners could receive a discount on property insurance.

“You are talking about business owners who could save as much as 12-16 percent if their establishment goes non-smoking,” he said.

Dugger, who said during a previous meeting that he didn’t want the city overstepping its bounds, said if the ordinance was needed, he did not want to see it become a large debate.

“If this is something we are going to make a decision on, I want us to get it done without dragging it out,” he said.

In other board business:

•Property owned by Newt Davis at 208 Van Voris St., was rezoned from C-2 commercial to C-1 commercial.

•Water and Sewer Superintendent Mike Ross gave an update on the sewer line relocation behind Bancorp South, saying the job should be completed by Tuesday of next week.

•Aldermen discussed a sales contract to purchase a neighboring building from C. Gaines Baker to be used as a new home for the Code Enforcement Office.

•Fire Chief Tim Taylor was given permission to repair the tornado siren on Highway 51 at a cost of $2,900.

So...can we say "more government" in our lives. Public eating places and City property, is one thing, but a private business? Hey City of Batesville, are you gonna change my light bulbs for me too? I didn't think so. I really think this is going too far and not what we want to see in our leaders. "You can't smoke in the park, but you can sell your dope there". What is next? I can't smoke at my home. And just think even the non smokers are tired of being told every little move to make. Buy the way, I guess you can tell I am a smoker. But I do respect those that do not smoke, and do so without being told.

Just to clear up the insurance break for places, such as the City of Batesville or any other place else. You must be "tobacco free", this is ALL forms of tobacco not just smoking. As far as private business. "We can't pick up tires someone dumped on your property, because it is private property". We can't work a wreck on private property, but we can say "you can't smoke". And as Mr. Dugger put it, how long before we say your perfume is too loud? By the way, does this go for the Country Club also? Or that social drinker at Cafe Ole?

I love how the smokers always say, I am considerate of others when I smoke. Are you kidding me? Other cities have adopted non-smoking policies and their sales have risen. Who wants to eat in a smoke filled restaurant or walk out of a business with smoke being blown in your face. Wake up, this has nothing to do with government and everything to do with your health. You may not care about polluting your lungs, but you should respect those who dont smoke.

Thank you "Big Brother!". I will continue to do what I always have as a smoker and refrain from smoking in public and on "your" property and I will wait for the next "health related ban" which will be aimed at the over weight and the "Fat Tax". Please don't get upset if I'm not one of the first in line voiceing outrage when that happens though.

Batesville, since you have joined the Federal Government, Germantown, TN and Cordova, TN in saving us from ourselves please by all means keep on going. You need to do something about women's perfume and men's cologne. My God, some people put so much on or the smell of it is so offensive it plays heck with the nasal linings, makes a person's eyes water and induces coughing like no cigarette has ever done. Please put a stop to stinking in Batesville. You might also install showers at the city limits so visitors can clean up before entering the city. You can charge for the showers and soap and towels. Just think of the revenue you can receive.

I have an office in Memphis. Up until a couple or three years ago it was legal to smoke in my office. In an attempt to discourage smokers many years ago, I took out all of my ash trays. Smokers then began using the cup on my desk where I kept pens for them to use if they had to sign something. Candy dishes...oh, how they loved to put their ashes amongst the butterscotch hard candy. One of 'em used MY coffee cup. Another one put a cigarette on a new table in my front office and I now have a table with a 2 inch burn in the wood. When the city/state banned smoking in all private offices I figured some of those nervous clients would still try to smoke in my office because, for some reason, they think nicotine calms them down. Instead,folks now go outside to smoke on the sidewalk or, in this cold weather, in their cars. Some will get up and go outside half a dozen times in an hour. But, speaking as someone with a breathing problem and one who suffers a physical reaction from the smoke causing me to be unable to breathe without looking like a catfish laying on the bank of the river, this whole non-smoking thing has turned out quite well . .. . . ... All of us civil libertarians who believe that gov't should stay out of our personal lives... but who don't smoke... think this no-smoking thing is pretty good. Give it a chance... Besides, there is nothing more disgusting than cigarette ashes mixed in with what used to be the syrup you put on your pancakes you had for breakfast out at MickeyD's or Cracker Barrel.

The board is geeting way out of hand in this town and others. I know many people that smoke and don't smoke, and they have no problem with having a smoking area in a public place. Which most places have. If they needs to be a law saying they must have certain ventalation fine, but who gives a hand full of people to take away the rights of customers and bussiness'. Just because you may get a wiff of the smell of smoke does not mean you are getting the poisonous chemicals. That would be the same as saying you could get them from the smell being on someones clothes. Also look at the way Florida did there laws, you can't smoke in places that serve food or have to wait until they stop serving food, and then are allowed to smoke. And yes it will hurt the bussiness it happened in oxford, which increased it here.

I don't smoke, never have, and I don't agree with the ban. I see it as another right being taken away from citizens from those who smoke to those who own the business that has to prohibit the act. Like Bob says, next there will be a tax on food to help cut down on obesity. Then what's next? George Harrison sang this line.."Let me tell you how it will be....one for you nineteen for me....cause I'm the taxman." Let's start digging a little deeper into the old pocketbook!

Do you really think this will pick up business - I don't think so, more like cause a slow down. We need to take a better look at who we are putting in office. Isn't there enough city business to take care of besides having to get personal. That liquor sales on Sundays should have been stopped, who did it benefit (drinkers). Give me a break!

Iam NOT proud to say I voted for Stan Harrison. As a business owner, I'm sure it makes him no difference whether you do or do not smoke in Cafe' Ole. You wouldn't smoke in Wal Mart,Stubb's etc. but come on..a bar like The Tavern on the Square, O'Daley's and Cafe' Ole... that is taking it too far!!! I think most people that go into a bar are there to drink and if you drink you probably are a smoker. I realize "some" are not. If you know that a business sells alcohol and has live bands on the weekends, then there are going to be smokers there. Go to a resturant that is smoke free!!! I wish smokers would boycott all downtown Batesville businesses. I guess this ordinance means you can't smoke in the open air on the sidewalks of city limit property. The streets belong to the city. Does that mean if I go to may mailbox at my house, step onto the street, then I am subject to a fine? All I can say is you better hire a lot more officers to catch us "bad smokers"!!!! Some of you say sales have risen due to nonsmoking ordinances. Let's just see. Does it also include the sidewalks in front of Cafe'Ole and O'Daley's? We know it applies to The Tavern!! I'm sure I'll get some feedback from my comment so BRING IT ON!! (That is until the city decides who can say what, where and when you can voice your opinion). Every smoker needs to flood the aldermen that voted for the ban with mail voicing your opinion. (Not that it will change anything bt it will give a sense of satisfaction!!)

Re: Outside Looking In Ok "OLI" lets say next week the City of Batesville wanted to ban big SUVs, $200,000.00 homes. Does this start to strike a nerve? We are all too often to fuss about something that affects us directly. What most of us are saying, smokers and non smokers, is that we are feed up with Government control of our lives. I don't know you but I would step out and say Democrat or government employee, or worse, maybe both. I run a business in Batesville that owners are already thinking of moving due to the tax base. Do you think they need more help? City property and eating places, one thing. Private property is a whole new game. You are fine now, but wait until it involves you directly. Then will you still hold up these folks? At the rate things are going, you will get your chance to fuss about something.

For years you have had your chance. I know what you are thinking..."I'm a polite smoker who is considerate of others." If that's so, you are in the lower 1% of smokers. Why didn't you police the impolite smokers? I'm sick of having to smell smoke when I eat. I'm sick of you trashy smokers thumping your buts to the ground as you enter a building. I'm sick of you throwing your buts in the landscaping at the drive through windows, in my yard, the park, in the road, and on the golf course. I'm sick of working with smokers who are half as productive as me. "Half as productive", you say? Yes, half as productive. Every smoker I know has to stop their work every hour to take a smoke break. Then they have to regulate their digestion with another break after their cigarette. The rest of us continue working. Most of you are the same people who complain about insurance and medical prices, yet you smoke. You complain about taxes on cigarettes, yet the mere habit of smoking raises taxes due to state sponsored health programs. The bottom line is that nobody told you that you can't smoke at home or in your car, you just can't ruin things for us non-smokers in public places. And why should you be able to? You have as much right to blow smoke on me as I do to spit on you. Again, you guys had your chance and blew it. And for the comments on laws about obesity. I would welcome that too. Have you been in WalMart lately?

I'm happy my child does not have to breathe in contaminated air and hurt her precious developing lungs. Thank you! Can someone please explain this to me? You can't sit and smoke after a meal but you can go out and buy all the cold beer you want on Sunday and get drunk. This will lead to an auto accident that just might cause someone to lose their life. This is as smart as a town selling liquor and not beer or selling hot beer but not cold beer. Is there any common sense anymore?

Drink and sell beer on sunday put please don`t smoke.. How dumb,this board reminds me of Dumb And Dumber..They must be watching Congress and the great Harry and Nancy and their boss.. Hey don`t we have a board member that has interest in a bar on number six highway..Cafe-o-..Please voters,the least we can do for our children is to get rid of Stan and Ted and maybe Eddie.. Fix the roads and sewer and etc..It looks like Bill Dugger is the only one with any common sense.. The Mayor can only make a joke out of everything.. We bdeserve better for I children
